Conditions of Enrolment

1Conditions of Enrolment
  • You understand that CPA is not liable for any claims, costs or damages arising from any breach of these Terms and Conditions.
  • Chakravyu Performing Arts (CPA) leases venues to conduct its activities. CPA is not liable if you acquire an injury or theft or any other mishap, including death, from a default of the venue. CPA is also not liable for any claims, costs or damages arising as a result of the incident/s mentioned above, unless it is the direct result of a Teaching Artist/Facilitator inappropriate instruction that is in breach of venue policies.
  • You agree that you have read and understood the provisions of these Terms and Conditions.

Cancellations and Transfers

1Workshops/Public/Open Courses/Programs:
  • Cancellations made 10 working days or more in advance of the event date will receive a 90% refund. Cancellations made within 3 – 9 working days will receive a 50% refund. Cancellations made within 48 hours to the event will receive a 10% refund.
  • Once the program date has arrived, there are no refunds for drop-outs or no-shows unless through death or serious injury (meaning hospitalisation for which the candidate will be required to show documents as proof). Any Costs incurred by the company in preparation for participation will be deducted from the refund.
  • Sickness does not incur a refund and the registered participant is welcome to request to allocate a replacement participant.
  • Substitutions of participants can be made only by contacting us 3 days prior the start date of the program.
  • The Teaching Artist/facilitator of the event has the right to ask you to wait outside of the event space until a suitable entry time. If you are late for your service, we may not be able to accommodate you immediately if a numbers-driven exercise has been actioned. You will be asked to sit and observe until an appropriate time to actively join the session. If you decide to leave the space, it will be regarded as a late cancellation and you may not be permitted to return.
  • Should Chakravyu Performing Arts need to cancel a course a full refund of the course fee will be obtainable. We accept no liability for any other costs.
  • Chakravyu Performing Arts may record the event for marketing, quality, safety and training purposes, including the ongoing training of enrolled students. All images and recordings are stored securely in Chakravyu Performing Arts’s digital storage. Images are utilised only for archival and/or marketing purposes. By enrolling in this class and 18yrs and over you are agreeing to be recorded for these express purposes. It is the responsibility of the user to request (in writing) that Chakravyu Performing Arts does not use your image. If under the age of 18yrs, consent will be requested from the parent/guardian before Chakravyu Performing Arts is able to utilise any image of a child.

1Scope

Therefore, The Company expects that any interaction within the Company will be treated as a business relationship, free from discrimination, prejudice and harassment.

5Reporting Harassment and Discrimination, Protection Against Persecution for Reporting Harassment
  • The Company is positive about reports of any events of discrimination or harassment observed. The Company’s policy envisages prompt and thorough investigation of all such complaints. The Company prohibits persecution of any person who reports discrimination or harassment, or participates in investigation of such complaints.

  • The Company is positive about notifications of any events of discrimination, harassment or persecution, irrespective of who the abuser is and what his position is. Individuals who believe that they appeared to be the victims of such conduct should discuss their concerns with Senior Management of The Company or anonymously via email: yourcompanycpa@gmail.com
  • Moreover, The Company recommends the individuals, who consider that they are subjected to such conduct, to immediately inform the abuser that his/her behavior is offensive and to ask them to stop such behavior. Nevertheless, The Company acknowledges that such individuals may prefer to resolve the issue through the complaint procedure.
  • Revenge in respect of the person who reported harassment, persecution or discrimination, or participated in investigation of the harassment, persecution or discrimination complaint is considered to be a serious violation of this policy. Revenge for reporting harassment, persecution or discrimination, along with harassment, persecution and discrimination itself, may be the ground for disciplinary actions. Any revenge shall be immediately reported, promptly investigated and appropriate actions shall be taken thereon.
6Complaint Procedure

  • The Company welcomes prompt reporting of complaints and concerns, as it facilitates the process of taking quick and meaningful actions before the relationship is ultimately damaged. Although no period is fixed for notifications, prompt informing of incidents and interferences is the most effective way to resolve actual or supposed events of harassment.
  • Any accusations of harassment, discrimination or persecution will be promptly investigated. The investigation may involve individual interviews with the parties concerned and, where necessary, with persons who have witnessed the conduct, which became the subject of accusation, or possess other relevant information.
  • In the course of investigation, the information will be kept confidential to the extent needed for such investigation and appropriate corrective actions.
7Responsibility
  • Appropriate actions will be taken in response to misconducts, including harassment, discrimination or persecution. Such actions may include, but not limited to, training, talks to a consultant or disciplinary measures, such as a warning, reprimand, refused promotion or salary increase, transfer to another position, temporary suspension from work with no salary payment, or cancellation of an employment agreement, depending on what The Company deems appropriate in certain circumstances.
  • Where the party, being subject of the filed complaint, does not agree with the decision taken, it may appeal in writing to Senior Management.
  • False and bad-faith complaints of harassment, discrimination and persecution (as opposed to good-faith complaints, even if they are fundamentally wrong) can be the ground for appropriate disciplinary actions.
